1. Overview & General Policy
The primary goal of Asushost Limited is to provide highly reliable, exceptionally fast, and secure hosting environments. This Acceptable Use Policy ("AUP") is designed to protect our network, our customers, and the broader internet community from malicious, irresponsible, or illegal activity.
All users of Asushost services—including shared hosting tenants, VPS administrators, reseller accounts, and email users—must adhere strictly to this policy. Failure to do so will result in immediate service suspension or account termination without any liability to Asushost.
2. Prohibited Content & Websites
We do not permit our systems to host, process, or link to content that is illegal, dangerous, or harmful to others. The following types of websites and data are strictly prohibited on all Asushost servers:

Pirated / Unlicensed Content (Warez): Torrent files, unauthorized media streaming repositories, cracked software, nulled themes, plugins, or software key generators (keygen).

Malicious Material: Malware, spyware, backdoors, viruses, trojans, web shells, exploit scripts, phishing templates, or command-and-control (C2) server frameworks.

High-Risk Financial Services: HYIPs (High Yield Investment Programs), unregistered currency exchange bureaus, fraudulent lottery sites, escrow scams, or Ponzi schemes.

Explicit Content: Highly graphic adult content, illegal pornography, non-consensual imagery, or sexually explicit forums.

Hate Speech & Harassment: Any content that incites violence, promotes hate groups, defames individuals, or facilitates cyberbullying.
3. Strict Email & Anti-Spam Rules
Asushost maintains a zero-tolerance policy against outbound spam, phishing emails, and bulk marketing practices that damage our server IP reputations.

Sending Limits: Accounts on shared and reseller hosting plans are strictly limited to sending a maximum of 100 emails per hour. Any volume higher than this must be migrated to a dedicated VPS or professional email hosting plan.

Unsolicited Bulk Email (Spam): You are completely forbidden from sending unsolicited marketing campaigns, cold-outreach mailing lists, or scraping emails to build list databases.

Mailing Lists: If you run an opt-in mailing list, it must contain a clear, automated 1-click "Unsubscribe" header. Double-opt-in logs must be maintained and made available to Asushost upon request.

System Backlists: If an IP address assigned to your account becomes blacklisted by major spam blocklists (such as Spamhaus or Barracuda) due to your outbound mail activity, you will be billed a recovery and IP cleanup fee of KES 5,000 per occurrence.
4. System Abuse & Network Attacks
You may not use Asushost servers, virtual machines, or network interfaces to disrupt, monitor, or probe external internet systems. Prohibited activities include:

Denial of Service (DoS/DDoS): Initiating, participating in, or harboring command setups for denial-of-service attacks against external networks, databases, or online servers.

Vulnerability Scanning: Running port scanners, security probes, automated web exploit tools, or brute-force scripts from your hosting account without explicit, prior written authorization from both Asushost and the target network administrator.

Proxy, VPN, and Anonymizers: Running public proxies, open VPN relays, TOR exit nodes, or traffic-tunneling tools on shared resources.

Crypto-Mining: Utilizing system CPU, storage controllers, or RAM to mine cryptocurrencies (e.g., Bitcoin, Monero) is completely prohibited on shared, WordPress, reseller, and standard VPS instances.
5. DMCA & Intellectual Property Infringement
Asushost respects the intellectual property rights of others. If we receive a verified digital copyright complaint (DMCA notice or local equivalent) regarding content hosted on your account, we will act promptly:

Notification Process: Upon receiving a valid complaint, we will notify you and provide a 24-hour window to remove the infringing content or file a valid counter-notice.

Emergency Removal: If the client fails to respond or refuses to remove highly explicit copyright violations within the specified timeframe, we reserve the right to temporarily disable the directory or suspend the account to prevent further legal liability.
6. Enforcement, Violations, & Account Termination
If an account is determined to be in violation of this AUP, Asushost reserves the absolute right to choose the appropriate path of action:

System Warnings: For minor or accidental infractions, we may issue an official email warning with instructions to remediate the issue within 12 hours.

Immediate Suspension: For critical violations (including active phishing pages, outbound spam attacks, or DDoS participation), we will suspend the account immediately to protect our global network.

Evidence Retention: Suspended files and access logs may be securely preserved to satisfy inquiries from law enforcement agencies.
